1. E-Auction is being held on AS IS WHERE IS and NO COMPLAINT BASIS.

2. The E-auction will take place through portal www.mstcecommerce.com/auctionhome. Online auction will start automatically on and at the time mentioned above. However, the closing time of e-Auction will be automatically extended up to last Bid time, plus 8 minutes, so that opportunity is given to other Bidders for making an improved Bid on that item.

3. For detailed procedure and terms and conditions of E-Auction, interested bidder may visit www.mstcecommerce.com/auctionhome and download relevant documents. Interested bidders may also get in touch with service provider on below mentioned contact numbers.

4. It shall be in the discretion of the Authorized Officer to cancel the auction proceeding for any reason and return the EMD submitted and Bankwould not entertain any claim or representation in that regard from the bidders.

5. Particulars specified in respect of the said property in above schedule have been stated to the best of the information of the Authorized Officer / Bank but Authorized Officerand /or Bankwill not be answerable for any error, mis-statement or omission.

6. The intending purchaser / bidder is required to submit amount of EMD by depositing the amount in account No. 33216248387 of SBI, India Exchange Place Extension Branch, Code-01139 (IFSC -SBIN0001139) by 4.00 p.m. on or before 24/03/2014 (Date) along with completed bid form which can be downloaded from MSTC's website www.mstcindia.co.in and get training on E-Auction from M/s MSTC Limited, Kolkata. 7. The Bid Form along with the aforesaid Earnest Money Deposit (EMD) should be made in a sealed cover super scribed "Offer for purchase of', so as to reach the office of State Bank of India. India Exchange Place Extension Branch, P-15. India Exchange place Extension. Todi Mansion. Kolkata-700073 by 04.00 p.m. on or before 24/03/2014

8. The said EMD shall be adjusted in the case of highest bid, otherwise refunded at the earliest. The earnest money deposit will not carry any interest.

9. The sale shall be confirmed in favor of the purchaser who has offered the highest sale price in his bid to the Authorized Officer and shall be subject to confirmation by the Bank.

10. The purchaser shall deposit 25% of the amount of sale price after adjusting the Earnest Money Deposit within 48 hours of acceptance of highest bid by the Authorized Officer in respect of sale, failing which the earnest money deposit shall be forfeited. The highest bidder shall be declared to be the purchaser of the property mentioned herein provided always he is legally qualified to bid.

11. The balance amount of the sale price shall be paid by the purchaser on or before 15th day (during banking hours) of confirmation of sale by the Authorized Officer or such extended period as agreed upon in writing by and solely at the discretion of the Authorized Officer.

12. In default of payment of sale price or any part thereof within the period(s) mentioned herein above, the deposit(s) shall be forfeited and the property shall be resold and the defaulting purchaser shall forfeit all claims to the property or any of the sum for which it may be subsequently sold.

13. On confirmation of the sale by the Bank and on compliance of the terms of payment the Authorized Officer shall issue a certificate of sale of the said property in favor of the purchaser in the form given in Appendix V to Enforcement of Security Interest Rules.

14. The Authorized Officer is not bound to accept the highest bid or any or all bids and reserves the right to accept or reject any or all the bids without assigning any reason thereof.

15. The successful purchaser would bear all the charges / fees payable for conveyance such as stamp duty, registration fee etc. as applicable as per law of Government of India and State of West Bengal and other Authorities.

16. To the best of the knowledge and information of the Authorized Officer no other encumbrance exists on the property.

17. The authorized officer/secured creditors shall not be responsible for any charges, lien, encumbrances, property tax or any other dues to the Govt. or any body in respect of the properties under sale.

18. The successful bidder/s shall bear exclusively all the charges/taxes/rates payable for conveyance, any other known/unknown liability, expenses, property tax, any other dues to the Govt or anybody in respect of properties/assets sold.

19. All Statutory/non statutory dues, taxes, rates, assessments charges, fees etc owing to anybody will be the responsibility of the buyer only.

20. Before participation in the e-Auction, a prospective buyer shall be required to get themselves / himself registered with MSTC. To register, a buyer need to fill an online form in the web site www.mstcecommerce.com/auctionhome. User Id and password are generated by the buyer himself during online registration. The bidders other than individuals shall also submit proper mandate for e-bidding.

21. If the borrower pays in full the amount due, before the date of acceptance of bid by Bank, the e-auction will not be acted upon and necessary communication will be sent.

22. The sale is subject to confirmation by the secured creditor bank.

23. Neither SBI nor service provider will be responsible for any lapses/failure on the part of the bidder, in such cases, to ward off such contingent situations, bidders are requested to make all necessary arrangements/alternatives such as back-up power supply where ever inquired.
